That membership program gave members 2 things&#8230;<\/p><ol><li>Members were able to sell digital products created by the company.<\/li><li>Members could generate income by driving new sales for the program.<\/li><\/ol><p>This program was sold over the phone, which exposed them to Telemarketing Sales Rule violations.<\/p><p>Remember, if you sell over the phone, you are at a HIGHER level of risk!<\/p><p>Here are some of the key takeaways from the FTC&#8217;s <a href=\"https:\/\/lurnnation.slclktrk009.com\/track\/click?linkData=1-31b8eyJsaW5rIjoiaHR0cHM6XC9cL3d3dy5mdGMuZ292XC9zeXN0ZW1cL2ZpbGVzXC9mdGNfZ292XC9wZGZcL1dlYmxpby1Db21wbGFpbnQucGRmIiwibmV3c2xldHRlcklkIjoiMTU4MTMiLCJzdWJzY3JpYmVySWQiOjMwNjQxMzksImRvbWFpbiI6Imx1cm5uYXRpb24iLCJ0cmFja2luZ0RvbWFpbiI6Imx1cm5uYXRpb24uc2xjbGt0cmswMDkuY29tIiwidGltZSI6MTcyNzA5NTQ5MSwiZGVsIjo4LCJzZW5kZXIiOjMyMn0\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>complaint letter<\/strong><\/a>.<\/p><p><strong>Remember:<\/strong> This is the FTC&#8217;s point of view.<\/p><p><strong>#1 &#8211; Customer Complaints<\/strong><\/p><p>The FTC claims that &#8220;consumers have filed more than 230 complaints with the FTC regarding robocalls, including ringless voicemails, associated with Defendants\u2019 Blueprint to Wealth scheme.&#8221;<\/p><p>Customer complaints &#8211; especially if they are being sent directly to the FTC &#8211; are a common way a company gets on the FTC&#8217;s radar.<\/p><p><strong>#2 &#8211; Not Getting Proper Authorization<\/strong><\/p><p>The defendants were accused of reaching out to prospects with <strong>pre-recorded sales message<\/strong> WITHOUT getting their consent. This is a violation of the Telemarketing Sales Rule.<\/p><p><strong>#3 &#8211; Earnings Claims<\/strong><\/p><p>The defendants used earnings claims at multiple points in their sales funnel.<\/p><p>You can see income claims on the lead generation page above. There were also earnings claims made during pre-recorded cold reach outs and during the sales calls.<\/p><p>Remember, any time you make an earnings claim you MUST be able to prove that it is a TYPICAL result for customers in your program and not just what your most successful customers make.<\/p><p>Contrary to their claims, these earnings were not a typical result for customers in the program.<\/p><p><strong>#4 &#8211; Testimonials Creating A Misleading Net Impression<\/strong><\/p><p>The defendants used testimonials of customers discussing how much money they made with the program. <strong>They also included pictures of checks<\/strong> they supposedly sent to members.<\/p><p>However, these testimonials were not substantiated and did not represent typical results of customers.<\/p><p><strong>#5 &#8211; Misrepresentations About The Program<\/strong><\/p><p>A major selling point was that the program was &#8220;done for you&#8221; and &#8220;low risk.&#8221;<\/p><p>The net impression customers took away was that they only had to invest a small amount of money into advertising, and they would generate passive income.<\/p><p>According to the FTC, this was NOT the experience of most customers.<\/p><p><strong>#6 &#8211; Targeting Vulnerable Groups<\/strong><\/p><p>The complaint notes that many of the customers of this program were retirees.<\/p><p>The FTC is known for putting extra scrutiny on businesses that market to vulnerable groups such as the elderly, veterans and disabled.<\/p><p><strong>#7 &#8211; Harsh Penalties<\/strong><\/p><p>The total monetary judgement was more than $7.5 million.<\/p><p>The 3 defendants paid far less than that. The FTC had to pivot.<\/p>\n<p>Instead of relying on Section 13(b) of the FTC Act to get relief for victims, they leaned more on Section 19.<\/p>\n<p>Section 19 empowers the FTC to issue very targeted rules for TELEMARKETING.<\/p>\n<p><strong>Telemarketing includes different forms of \u201cone-to-one selling.\u201d<\/strong> Telephone, Zoom, the backroom of an event\u2014anything where a sales representative is having a personal conversation is governed under Section 19.<\/p>\n<p>The \u201cTelemarketing Sales Rule (TSR)\u201d that we reference all the time came from Section 19.<\/p>\n<p>This includes, but is not limited to, <strong>falsely representing the&#8230;<\/strong><\/p><ul><li>Price<\/li>\n<li>Potential returns<\/li>\n<li>Product effectiveness<\/li>\n<li>Earnings potential<\/li>\n<li>Any other representations that push a consumer into an unfair sale<\/li>\n<\/ul>\n<p>Basically, Section 19 is about truthful and fair advertising practices in one-on-one situations.<\/p>\n<p>Section 19 also allows the FTC to freeze assets, levy fines, collect damages, and much more.<\/p>\n<p>It then comes as no surprise that the FTC is currently focusing most of their activity and investigations under Section 19.<\/p>\n<p><strong>Big Takeaway:<\/strong> If you sell one on one, you are at a higher risk of getting the attention of the FTC right now because of Section 19.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>Good morning!
