However, the winner will have an opportunity to make their mark on the agency.<\/p><p>What kinds of changes could we expect, and <strong>what does it mean for businesses and marketers?<\/strong><\/p><p>Some people believe that if Trump gets elected, there will be BIG changes with the FTC and other regulators.<\/p><p>Some even believe that businesses and marketers will be able to say whatever they want!<\/p><p>Is this true? Let&#8217;s look at the facts.<\/p><p><strong>TLDR:<\/strong><\/p><ul><li style=\"line-height: 1.5;\">The leadership of the FTC might change<\/li><li style=\"line-height: 1.5;\">The FTC&#8217;s <strong>big-picture focus could change<\/strong>, especially around anti trust<\/li><li style=\"line-height: 1.5;\">The people doing the day to day work won&#8217;t change<\/li><li style=\"line-height: 1.5;\">The <strong>underlying laws<\/strong> probably won&#8217;t change<\/li><li style=\"line-height: 1.5;\">Courts will probably continue to be more hostile to regulators<\/li><li style=\"line-height: 1.5;\">You&#8217;ll still need to <strong>follow the rules regardless of who wins<\/strong><\/li><\/ul><p><strong>#1 &#8211; FTC Leadership Might Change<\/strong><\/p><p>The president has the power to appoint the chair of the FTC. Lina Khan, appointed by President Biden, holds that position right now.<\/p><p>Harris might keep the current chair since they belong to the same party.<\/p><p>She might also make a change. There have been <a href=\"https:\/\/lurnnation.slclktrk009.com\/track\/click?linkData=1-fc42eyJsaW5rIjoiaHR0cHM6XC9cL2ZpbmFuY2UueWFob28uY29tXC9uZXdzXC9rYW1hbGEtaGFycmlzLWRvbm9ycy1wcml2YXRlbHktdXJnZS0xODQ1MTU4NjYuaHRtbCIsIm5ld3NsZXR0ZXJJZCI6IjE1Nzg3Iiwic3Vic2NyaWJlcklkIjoxMzc2MiwiZG9tYWluIjoibHVybm5hdGlvbiIsInRyYWNraW5nRG9tYWluIjoibHVybm5hdGlvbi5zbGNsa3RyazAwOS5jb20iLCJ0aW1lIjoxNzI2MTQ1MjczLCJkZWwiOjEwLCJzZW5kZXIiOjMyMn0\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>reports<\/strong><\/a> that she is being urged by some of her donors to replace Lina Khan.<\/p><p>If the Republicans take control of the Senate, which they are <a href=\"https:\/\/lurnnation.slclktrk009.com\/track\/click?linkData=1-0d21eyJsaW5rIjoiaHR0cHM6XC9cL3d3dy5jb29rcG9saXRpY2FsLmNvbVwvcmF0aW5nc1wvc2VuYXRlLXJhY2UtcmF0aW5ncyIsIm5ld3NsZXR0ZXJJZCI6IjE1Nzg3Iiwic3Vic2NyaWJlcklkIjoxMzc2MiwiZG9tYWluIjoibHVybm5hdGlvbiIsInRyYWNraW5nRG9tYWluIjoibHVybm5hdGlvbi5zbGNsa3RyazAwOS5jb20iLCJ0aW1lIjoxNzI2MTQ1MjczLCJkZWwiOjEwLCJzZW5kZXIiOjMyMn0\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>favored<\/strong><\/a> to do, then <strong>she would have to appoint someone who could win the votes of Republicans<\/strong> who are skeptical of government regulations.<\/p><p>If Trump wins, he\u2019ll pick a new leader for the FTC who matches his ideas, just like he did in his first term.<\/p><p>This person will likely have different priorities than Lina Khan. Which leads us to&#8230;<\/p><p><strong>#2 &#8211; FTC Priorities Might Change&#8230;<\/strong><\/p><p>Under the leadership of Lina Khan, the agency has prioritized <strong>anti trust<\/strong>.<\/p><p>The FTC has sued companies like Amazon for &#8220;<a href=\"https:\/\/lurnnation.slclktrk009.com\/track\/click?linkData=1-b5fdeyJsaW5rIjoiaHR0cHM6XC9cL3d3dy5mdGMuZ292XC9uZXdzLWV2ZW50c1wvbmV3c1wvcHJlc3MtcmVsZWFzZXNcLzIwMjNcLzA5XC9mdGMtc3Vlcy1hbWF6b24taWxsZWdhbGx5LW1haW50YWluaW5nLW1vbm9wb2x5LXBvd2VyIiwibmV3c2xldHRlcklkIjoiMTU3ODciLCJzdWJzY3JpYmVySWQiOjEzNzYyLCJkb21haW4iOiJsdXJubmF0aW9uIiwidHJhY2tpbmdEb21haW4iOiJsdXJubmF0aW9uLnNsY2xrdHJrMDA5LmNvbSIsInRpbWUiOjE3MjYxNDUyNzMsImRlbCI6MTAsInNlbmRlciI6MzIyfQ\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>maintaining monopoly power<\/strong><\/a>.&#8221; They&#8217;ve also passed new rules, such as the ban on non-competes, to promote competition.<\/p><p>Republican members of the FTC, along with Republicans in congress, have opposed many of these actions.<\/p><p>If Trump appoints a new chair that aligns with the views of most Republicans, then the FTC will deemphasize anti trust. They might drop or settle some ongoing lawsuits and roll back some recent rules.<\/p><p><strong>#3 &#8211; &#8230;But Not As Much As You Might Think<\/strong><\/p><p>Many of the actions the FTC takes have support in both parties. For example, the <a href=\"https:\/\/lurnnation.slclktrk009.com\/track\/click?linkData=1-f874eyJsaW5rIjoiaHR0cHM6XC9cL3d3dy5mdGMuZ292XC9uZXdzLWV2ZW50c1wvbmV3c1wvcHJlc3MtcmVsZWFzZXNcLzIwMjRcLzA4XC9mZWRlcmFsLXRyYWRlLWNvbW1pc3Npb24tYW5ub3VuY2VzLWZpbmFsLXJ1bGUtYmFubmluZy1mYWtlLXJldmlld3MtdGVzdGltb25pYWxzIiwibmV3c2xldHRlcklkIjoiMTU3ODciLCJzdWJzY3JpYmVySWQiOjEzNzYyLCJkb21haW4iOiJsdXJubmF0aW9uIiwidHJhY2tpbmdEb21haW4iOiJsdXJubmF0aW9uLnNsY2xrdHJrMDA5LmNvbSIsInRpbWUiOjE3MjYxNDUyNzMsImRlbCI6MTAsInNlbmRlciI6MzIyfQ\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>recent FTC rules on fake reviews &amp; testimonials<\/strong><\/a> were approved by a unanimous vote from both Republican and Democratic committee members.<\/p><p>There are even Republicans who like the FTC&#8217;s recent anti trust focus.<\/p><p>For example, Trump&#8217;s running mate JD Vance <a href=\"https:\/\/lurnnation.slclktrk009.com\/track\/click?linkData=1-75f2eyJsaW5rIjoiaHR0cHM6XC9cL3RoZWhpbGwuY29tXC9wb2xpY3lcL3RlY2hub2xvZ3lcLzQ0OTEzNjMtdmFuY2UtYmlkZW4tZnRjLWNoaWVmLWlzLWRvaW5nLWEtcHJldHR5LWdvb2Qtam9iXC8iLCJuZXdzbGV0dGVySWQiOiIxNTc4NyIsInN1YnNjcmliZXJJZCI6MTM3NjIsImRvbWFpbiI6Imx1cm5uYXRpb24iLCJ0cmFja2luZ0RvbWFpbiI6Imx1cm5uYXRpb24uc2xjbGt0cmswMDkuY29tIiwidGltZSI6MTcyNjE0NTI3MywiZGVsIjoxMCwic2VuZGVyIjozMjJ9\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>said in February<\/strong><\/a> that, &#8220;I guess I look at Lina Khan as one of the few people in the Biden administration that I think is doing a pretty good job.&#8221; He specifically praised her on anti trust issues.<\/p><p>In 2020, during the Trump administration and led by a Trump-appointed chair, the FTC <a href=\"https:\/\/lurnnation.slclktrk009.com\/track\/click?linkData=1-cbf5eyJsaW5rIjoiaHR0cHM6XC9cL3d3dy5mdGMuZ292XC9uZXdzLWV2ZW50c1wvbmV3c1wvcHJlc3MtcmVsZWFzZXNcLzIwMjBcLzEyXC9mdGMtc3Vlcy1mYWNlYm9vay1pbGxlZ2FsLW1vbm9wb2xpemF0aW9uIiwibmV3c2xldHRlcklkIjoiMTU3ODciLCJzdWJzY3JpYmVySWQiOjEzNzYyLCJkb21haW4iOiJsdXJubmF0aW9uIiwidHJhY2tpbmdEb21haW4iOiJsdXJubmF0aW9uLnNsY2xrdHJrMDA5LmNvbSIsInRpbWUiOjE3MjYxNDUyNzMsImRlbCI6MTAsInNlbmRlciI6MzIyfQ\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>sued Facebook<\/strong><\/a> for anti-trust violations.<\/p><p>The FTC&#8217;s anti-trust focus might continue even if Trump appoints a new chair.<\/p><p><strong>#4 &#8211; The People Handling Investigations Probably Won&#8217;t Change<\/strong><\/p><p>While the chair of the FTC matters, the people who actually handle investigations and decide who to file lawsuits against are usually career staff who have been there for years.<\/p><p>That means regardless of who wins the election and appoints the next FTC chair, most of the DAY-TO-DAY work would stay the same.<\/p><p><strong>#5 &#8211; The Underlying Laws Probably Won&#8217;t Change<\/strong><\/p><p>The Federal Trade Commission Act\u2014 the law that says what businesses can and can\u2019t do in their ads\u2014won\u2019t change without a vote from Congress.<\/p><p>These lawsuits that we talk about in this community are brought because the targets are accused of violating parts of the FTC Act.<\/p><p>Regardless of who wins the presidential election and which parties control congress, there\u2019s no indication that the FTC Act will change.<\/p><p>That means the <strong>basic rules prohibiting misrepresentations and other deceptive practices<\/strong> probably won&#8217;t change.<\/p><p><strong>#6 &#8211; Courts Will Probably Continue To Be More Hostile To Regulators<\/strong><\/p><p>Republican presidents tend to appoint judges who are skeptical of government regulations.<\/p><p>For example, the recent <a href=\"https:\/\/lurnnation.slclktrk009.com\/track\/click?linkData=1-63eeeyJsaW5rIjoiaHR0cHM6XC9cL3d3dy55b3V0dWJlLmNvbVwvd2F0Y2g_dj02R3JRSWVYTUxWSSZ0PTEwNjJzJmFiX2NoYW5uZWw9RG9uJTI3dFNheVRoYXQiLCJuZXdzbGV0dGVySWQiOiIxNTc4NyIsInN1YnNjcmliZXJJZCI6MTM3NjIsImRvbWFpbiI6Imx1cm5uYXRpb24iLCJ0cmFja2luZ0RvbWFpbiI6Imx1cm5uYXRpb24uc2xjbGt0cmswMDkuY29tIiwidGltZSI6MTcyNjE0NTI3MywiZGVsIjoxMCwic2VuZGVyIjozMjJ9\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>string of Supreme Court decisions<\/strong><\/a> weakening regulatory agencies have been driven by Republican-appointed justices.<\/p><p>If Trump wins the election, and the Republicans take control of the Senate, then we could expect more appointments of judges skeptical of regulators to be confirmed.<\/p><p>If Harris wins and Republicans control the Senate, it&#8217;s not clear if she&#8217;ll get to appoint any judges at all.<\/p><p>If the Democrats hold the Senate, then she would be able to appoint judges. However, it&#8217;s unlikely that there would be enough vacancies to change the current balance of the court.<\/p><p><strong>Bottom Line <\/strong><\/p><p>While it is true that the upcoming election impacts the FTC, for the vast majority of the readers of this marketers and business owners will still face the same level of risk with lawsuits if they are NOT compliant.<\/p><p>Remember: <strong>The FTC is NOT the only risk. <\/strong>There are other agencies, state AG&#8217;s, class action lawsuits and more.<\/p><p>Our advice is the same: learn the rules. Follow the rules. Is this requirement removed if you pause the recording when you take the card number? This would make things way easier to manage for us. However, <strong>they never got written permission to use these testimonials.<\/strong><\/p><p>At the end of the launch, they revealed that the launch had earned tens of millions of dollars. One of the women who had given a testimonial heard, and she found out that her testimonial, face, and likeness had been in all their marketing.<\/p><p>She sued them for a portion of their revenue that she claimed was due to her story. This led to an EXPENSIVE legal battle.<\/p><p>That&#8217;s why you need to get a proper release and authorization BEFORE using a testimonial.
