text-align: center;\"><strong style=\"color: #222222; font-family: Arial, sans-serif; font-size: 20px;\">Compliance Digest: What You Should Read Today<\/strong><\/p><p><a href=\"https:\/\/ago.nebraska.gov\/news\/nebraska-attorney-general-hilgers-files-lawsuit-against-social-media-%E2%80%9Cinfluencers%E2%80%9D-their\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>Nebraska Beauty Queen Faces Lawsuit Over Deceptive Marketing<\/strong><\/a><\/p><p>Social media influencer and current Mrs Nebraska, Elizabeth \u201cLiz\u201d Friesen, was sued last week by the Nebraska Attorney General for misleading customers about a dropshipping program.<\/p><p>According to the complaints, Friesen and the other defendants&#8230;<\/p><ul><li>Misled consumers by promising \u201cfinancial freedom\u201d through various \u201cpassive income\u201d services<\/li><li>The main service was a done for you <strong>Amazon and Walmart dropshipping stores<\/strong>.<\/li><li>They flaunted a high-end lifestyle and implied that buyers of this program will get rich as well.<\/li><li>In reality most customers lost money, with <strong>some losing over $100,000<\/strong>.<\/li><\/ul><p>According to the complaint, this misleading advertising<strong> resulted in more than $3 million<\/strong> in lost savings for Nebraska consumers&#8221;<\/p><p>The complaint features many examples of the kinds of violations we talk about in this newsletter &#8211; <strong>implied and express income claims, misrepresentations, misleading testimonials and more.<\/strong><\/p><p>Another interesting part of the case is that the state is trying to collect damages from the Friesen herself, claiming that she did not treat her corporation like a separate entity.<\/p><p>You can read the <a href=\"https:\/\/ago.nebraska.gov\/sites\/default\/files\/doc\/Friesen%20Complaint%20-%20Stamped%202024.11.12.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>full complaint here<\/strong><\/a>.<\/p><p>This is another reminder that <strong>states are a real threat<\/strong> to to marketers who use non-compliant marketing.<\/p><p><a href=\"https:\/\/www.ftc.gov\/news-events\/news\/press-releases\/2024\/11\/reports-unwanted-telemarketing-calls-down-more-50-percent-2021\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>Reports Of Unwanted Calls Down By 50%, According To The FTC<\/strong><\/a><\/p><p>The FTC reports that complaints about unwanted telemarketing calls have dropped by more than half since 2021, with robocalls seeing a steady decline for the third straight year.<\/p><p>The agency\u2019s efforts include cracking down on illegal telemarketing through initiatives like <a href=\"https:\/\/www.ftc.gov\/news-events\/news\/press-releases\/2023\/07\/ftc-law-enforcers-nationwide-announce-enforcement-sweep-stem-tide-illegal-telemarketing-calls-us\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>Operation Stop Scam Calls<\/strong><\/a> and expanding protections under the Telemarketing Sales Rule to address new threats like <a href=\"https:\/\/www.ftc.gov\/system\/files\/ftc_gov\/pdf\/FTC-Comment-VoiceCloning.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>voice cloning scams<\/strong><\/a>.<\/p><p>Complaints about <strong>medical and prescription-related robocalls<\/strong> were the most reported issue, while reports about imposters and debt-reduction scams also ranked high.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1a7e239 elementor-widget elementor-widget-image\" data-id=\"1a7e239\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"image.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<img decoding=\"async\" width=\"300\" height=\"157\" src=\"https:\/\/blog.dontsaythat.com\/wp-content\/uploads\/2024\/11\/R-300x157.jpeg\" class=\"attachment-medium size-medium wp-image-145\" alt=\"\" srcset=\"https:\/\/blog.dontsaythat.com\/wp-content\/uploads\/2024\/11\/R-300x157.jpeg 300w, https:\/\/blog.dontsaythat.com\/wp-content\/uploads\/2024\/11\/R-1024x536.jpeg 1024w, https:\/\/blog.dontsaythat.com\/wp-content\/uploads\/2024\/11\/R-768x402.jpeg 768w, https:\/\/blog.dontsaythat.com\/wp-content\/uploads\/2024\/11\/R.jpeg 1200w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/>\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-9a4ea07 e-flex e-con-boxed e-con e-parent\" data-id=\"9a4ea07\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-1c98b4b elementor-widget elementor-widget-text-editor\" data-id=\"1c98b4b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p style=\"text-align: center; line-height: 1.5;\"><strong style=\"font-size: 20px; color: #222222; font-family: Arial, sans-serif;\">Case Breakdown: Rejuvica&nbsp;<\/strong><\/p>\n<p>This is a case from 2023.<\/p>\n<p>Rejuvica LLC marketed an herbal supplement called Sobrenix, <strong>claiming it could reduce alcohol cravings and help manage alcohol consumption<\/strong>.<\/p>\n<p>The company advertised its product via websites, Amazon, and even staged appearances on television.<\/p>\n<p>The FTC accused Rejuvica of using deceptive marketing tactics to promote Sobrenix as an effective solution for alcohol use disorder, a condition that requires evidence-based treatment.<span style=\"color: var(--ast-global-color-2); font-family: Poppins, sans-serif; font-size: 1.5rem; font-style: inherit; font-weight: 600; text-align: var(--text-align); background-color: var(--ast-global-color-5);\">&nbsp;<\/span><\/p>\n<p>The FTC&#8217;s claims were denied by Rejuvica. Here is <a href=\"https:\/\/www.rejuvica.com\/pages\/rejuvica-ftc-settlement-7-19-23?gad=1\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>their response<\/strong><\/a>.<\/p>\n<h3>Here\u2019s What the FTC Says Rejuvica Did Wrong\u2026<\/h3>\n<h4><strong>#1 &#8211; Misleading Advertising Claims<\/strong><\/h4>\n<p>Rejuvica claimed that Sobrenix could reduce alcohol cravings, help users regain control of their drinking, and even treat alcohol use disorder.<\/p>\n<p>The problem? These claims were <strong>not supported by reliable evidence<\/strong>.<\/p>\n<p>The FTC points out that promoting a product as a treatment for a disorder without scientific backing is misleading and violates <strong>Section 12 of the FTC Act<\/strong>, which focuses on food, drugs, devices, services, and cosmetics.<\/p>\n<p>In addition, the defendants were accused of violating the <strong>Opioid Addiction Recovery Fraud Prevention Act<\/strong> &#8211; which focuses specifically on any substance use disorder treatment service or substance use disorder treatment product.<\/p>\n<h4><strong>#2 &#8211; Fake Review Websites<\/strong><\/h4>\n<p>Rejuvica created websites like \u201cAlcoholSupportSupplements.com\u201d to appear as independent review platforms.<\/p>\n<p>These sites ranked Sobrenix as the best product, but they were owned and operated by Rejuvica itself.<\/p>\n<p>These &#8220;reviews&#8221; misled consumers into believing the endorsements were unbiased, violating FTC\u2019s rules on advertising disclosures.<span style=\"color: var(--ast-global-color-2); font-family: Poppins, sans-serif; font-size: 1.25rem; font-style: inherit; font-weight: 600; text-align: var(--text-align); background-color: var(--ast-global-color-5);\">&nbsp;<\/span><\/p>\n<h4><strong>#3 &#8211; Misrepresentation Through Spokespersons<\/strong><\/h4>\n<p>Rejuvica paid health \u201cexperts\u201d to promote Sobrenix on TV shows.<\/p>\n<p>However, they did NOT disclose that these appearances were advertisements, creating the impression that the product was endorsed by independent professionals.<\/p>\n<p><strong>The Settlement<\/strong><\/p>\n<p>The FTC and Rejuvica agreed to a settlement. This isn&#8217;t illegal, but some marketers use it in a non-compliant way.<\/p><p>It comes down to whether your charitable contributions are REAL.<\/p><p>Far too many marketers claim to make donations, but don&#8217;t.<\/p><p>If you declare publicly that you\u2019ve donated to causes or done philanthropic work, <strong>make sure to document it and have substantiation<\/strong>.<\/p><p>They even raise the money from their audience and actually never donate! This is wrong on MANY levels, least of which is that it can expose you to lawsuits from more than just the FTC!<\/p><p>Secondly, assuming you do make donations, <strong>don\u2019t embellish or exaggerate them<\/strong> to make yourself look better.<\/p><p>Using public work as a marketing tool is heavily audited in regulatory investigations. It gets special attention.<\/p><p>Finally, <strong>keep proof of what you say<\/strong>. SPECIFIC and ACCURATE proof.<\/p><p>If you do charitable work, that\u2019s amazing.
