Violators may face legal claims and penalties.\u00a0<\/p><p>The FTC has also moved to ban <a href=\"https:\/\/www.ftc.gov\/news-events\/news\/press-releases\/2023\/10\/ftc-proposes-rule-ban-junk-fees\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>\u201cjunk fees.\u201d<\/strong><\/a> There is clearly a growing regulatory trend that businesses and marketers should watch closely.<\/p><p><a href=\"https:\/\/www.ftc.gov\/news-events\/news\/press-releases\/2024\/09\/ftc-orders-shut-down-unauthorized-billing-credit-card-laundering-schemes-require-turn-over-assets\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>FTC Settles With Marketers Of Keto And CBD-Related Products<\/strong><\/a><\/p><p>In September, the FTC settled with companies accused of unauthorized billing and credit card laundering by defendants marketing CBD and keto-related products.\u00a0<\/p><p>They allegedly enrolled consumers into unwanted continuity programs, violating Section 5 of the FTC Act, the Restore Online Shoppers&#8217; Confidence Act (ROSCA), and the Electronic Funds Transfer Act (EFTA).<\/p><p>Monetary judgments totaling $63 million were imposed, and the defendants must forfeit approximately $40 million in assets.\u00a0<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8fe9a7d elementor-widget elementor-widget-image\" data-id=\"8fe9a7d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"image.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<img fetchpriority=\"high\" decoding=\"async\" width=\"837\" height=\"837\" src=\"https:\/\/blog.dontsaythat.com\/wp-content\/uploads\/2024\/10\/QwhN4tsNWkYdAQpC1J4tm2mRknnajGVryCze6JhZ.png\" class=\"attachment-large size-large wp-image-103\" alt=\"\" srcset=\"https:\/\/blog.dontsaythat.com\/wp-content\/uploads\/2024\/10\/QwhN4tsNWkYdAQpC1J4tm2mRknnajGVryCze6JhZ.png 837w, https:\/\/blog.dontsaythat.com\/wp-content\/uploads\/2024\/10\/QwhN4tsNWkYdAQpC1J4tm2mRknnajGVryCze6JhZ-300x300.png 300w, https:\/\/blog.dontsaythat.com\/wp-content\/uploads\/2024\/10\/QwhN4tsNWkYdAQpC1J4tm2mRknnajGVryCze6JhZ-150x150.png 150w, https:\/\/blog.dontsaythat.com\/wp-content\/uploads\/2024\/10\/QwhN4tsNWkYdAQpC1J4tm2mRknnajGVryCze6JhZ-768x768.png 768w, https:\/\/blog.dontsaythat.com\/wp-content\/uploads\/2024\/10\/QwhN4tsNWkYdAQpC1J4tm2mRknnajGVryCze6JhZ-600x600.png 600w\" sizes=\"(max-width: 837px) 100vw, 837px\" \/>\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d6bed45 elementor-widget elementor-widget-text-editor\" data-id=\"d6bed45\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p style=\"text-align: center; line-height: 1.5;\"><strong style=\"font-size: 20px; color: #222222; font-family: Arial, sans-serif;\">Case Breakdown: KFC<\/strong><\/p><p>Today we&#8217;re going to quickly break down an interesting case from 20 years ago involving a popular fast food chain.<\/p><p>KFC, of course, is best known for its fried chicken.<\/p><p>In the early 2000&#8217;s, they tried to position themselves as a HEALTHIER alternative to other fast food chains.<\/p><p>Is fried chicken healthier than a cheeseburger? Not really.<\/p><p>That&#8217;s why, in 2004, the FTC brought an administrative action against KFC of making false claims in a national advertising campaign.<\/p><p>The company was accused of making <strong>unsubstantiated claims<\/strong> about its fried chicken\u2019s nutritional value, weight-loss benefits, and other health benefits.<\/p><p>\u00a0<\/p><p>One of the advertisements that the FTC flagged claimed that eating KFC fried chicken was healthier than eating a Burger King Whopper.<\/p><p>The problem is that while KFC&#8217;s fried chicken had slightly less total fat, <strong>it did have more trans fat, cholesterol, sodium and calories.<\/strong><\/p><p>Another said that eating fried chicken was compatible with a low-carb diet.<\/p><p>Of course, most low-carb diets DO NOT recommend eating breaded chicken!<\/p><p>KFC wasn&#8217;t punished severely for these violations. There are many great businesses in this industry, but it\u2019s also one that the FTC and other regulators have focused on.<\/p><p>If you\u2019re in this space, then you need to make sure you PRIORITIZE COMPLIANCE because it wouldn\u2019t take much for you to become the target of an investigation or lawsuit.<\/p><p><strong>State Laws<\/strong><\/p><p>In the late 1970s, several states began establishing <strong>Business Opportunity Disclosure (BODA) <\/strong>laws or <strong>Seller Assisted Marketing Plans Acts (SAMP)<\/strong>.\u00a0<\/p><p>These laws were specifically created to regulate businesses, such as franchises and \u201cmake money\u201d programs sold on infomercials.<\/p><p>In the early 2000s, the FTC and several states started using these same 1970s laws to govern education about making money that was being sold online.<\/p><p>Today, about 23 states have BODAs or SAMPs.\u00a0<\/p><p>For example, the California SAMP Act requires all \u201cSAMPS\u201d to offer a three-day right of rescission (right to cancel).\u00a0<\/p><p>Companies who fail to offer this right are liable to California prosecutors and<strong> private or even class action lawsuits<\/strong>.<\/p><p><strong>The FTC<\/strong><\/p><p>The FTC also has similar business opportunity provisions that it enforces nationwide.<\/p><p>Over the years both the FTC and state regulatory bodies have expanded the scope of business opportunity laws to include many money-making informational offerings, including but not limited to:<\/p><ul><li><strong>Real estate education<\/strong><\/li><li><strong>Amazon and Walmart businesses<\/strong><\/li><li><strong>Crypto currency offerings<\/strong><\/li><li><strong>Lending practices<\/strong><\/li><\/ul><p>The main complaint?\u00a0 Unsubstantiated claims that are not typical results. Misuse of testimonials that are not typical and high-pressure sales techniques used on the phone (telesales).<\/p><p>If you provide done-for-you business opportunity services, you are also subject to the <a href=\"https:\/\/www.ftc.gov\/business-guidance\/resources\/selling-work-home-or-other-business-opportunity-revised-rule-may-apply-you-1\" target=\"_blank\" rel=\"noopener noreferrer\"><strong>Business Opportunity Rule<\/strong><\/a>.<\/p><p>Under this rule, sellers of business opportunities must give potential buyers specific details to aid in their evaluation.\u00a0<\/p><p>This helps buyers understand the risks of acquiring a work-at-home program or similar business opportunities.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>Good morning!
